Flushy Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flushy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of the App

Flushy is a personal gut health tracking application that allows users to log bowel movements using the Bristol Stool Scale, track stool color, add contextual tags, and view health insights. All data is stored locally on your device. Some features are part of Flushy Pro (see Section 5).

3. Medical Disclaimer

The App is designed for informational and personal tracking purposes only. The health insights, scores, tips, and pattern analyses provided by the App are based on general wellness guidelines and should not be interpreted as medical advice. The Bristol Stool Scale classifications referenced in the App are based on established medical literature but their presentation within the App does not constitute clinical guidance.

You should:

• Always consult a qualified healthcare professional for medical advice
• Never disregard professional medical advice or delay seeking it based on information provided by this App
• Seek immediate medical attention if you experience concerning symptoms
• Not rely on this App as a substitute for professional medical diagnosis or treatment

4. User Responsibilities

You are responsible for:

• The accuracy of data you enter into the App
• Maintaining the security of your device and the data stored on it
• Creating backups of your data if you wish to preserve it (the App provides a backup feature for this purpose)
• Using the App in compliance with all applicable laws and regulations

5. Purchases and Flushy Pro

Depending on the store, Flushy is a paid download, or a free download with an optional in-app purchase called Flushy Pro that unlocks additional features.

• One-time purchase. Flushy Pro is not a subscription. You pay once, and it never renews or charges you again.
• Free trial. New installs may include a free trial of Flushy Pro. It needs no payment method, and nothing is charged when it ends: the App simply returns to its free features.
• Paid downloads. If you bought Flushy as a paid download, Flushy Pro is included at no extra cost. If you reinstall without a backup and Flushy Pro doesn't come back, contact us with your store order number.
• Payments and refunds. Purchases are made through your app store (Google Play or the Amazon Appstore) and are governed by its terms, including its payment, tax, and refund policies. Refund requests go through the store, and you can also contact us.
• Your purchase. Flushy Pro is tied to the store account you bought it with. After reinstalling the App, or on a new device signed in to the same account, use "Restore purchase" in the App to get it back.
• Your data is never locked. With or without Flushy Pro, everything you log stays visible in the App and is included in backups. We may change which features are part of Flushy Pro over time.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy. All data entered into the App is stored locally on your device. We do not collect, transmit, or have access to your data. As a result:

• We cannot recover your data if you lose your device or uninstall the App without creating a backup
• You are solely responsible for backing up your data
• We are not liable for any data loss resulting from device failure, App uninstallation, or any other cause

7. Intellectual Property

The App, including its design, code, graphics, icons, and content, is the property of Flushy and is protected by applicable intellectual property laws. You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App's name, logo, or branding without prior written permission
• Create derivative works based on the App

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim related to the App shall not exceed the amount you paid for the App and for Flushy Pro, if any

9. Health Information Accuracy

While we strive to provide accurate health information based on recognized medical sources (including the Bristol Stool Scale, World Gastroenterology Organisation, and World Health Organization guidelines), we do not guarantee the accuracy, completeness, or timeliness of any health information presented in the App. Health guidelines may change, and individual health conditions vary.

10. App Updates

We may release updates to the App from time to time. These updates may include bug fixes, new features, or changes to existing features. While we recommend keeping the App updated, we do not guarantee ongoing updates or support for any specific version.

11. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to discontinue the App at any time without prior notice, though we will make reasonable efforts to communicate significant changes.

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law provisions.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
