Flushy Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flushy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of the App

Flushy is a personal gut health tracking application that allows users to log bowel movements using the Bristol Stool Scale, track stool color, add contextual tags, and view health insights. All data is stored locally on your device.

3. Medical Disclaimer

The App is designed for informational and personal tracking purposes only. The health insights, scores, tips, and pattern analyses provided by the App are based on general wellness guidelines and should not be interpreted as medical advice. The Bristol Stool Scale classifications referenced in the App are based on established medical literature but their presentation within the App does not constitute clinical guidance.

You should:

• Always consult a qualified healthcare professional for medical advice
• Never disregard professional medical advice or delay seeking it based on information provided by this App
• Seek immediate medical attention if you experience concerning symptoms
• Not rely on this App as a substitute for professional medical diagnosis or treatment

4. User Responsibilities

You are responsible for:

• The accuracy of data you enter into the App
• Maintaining the security of your device and the data stored on it
• Creating backups of your data if you wish to preserve it (the App provides a backup feature for this purpose)
• Using the App in compliance with all applicable laws and regulations

5. Data and Privacy

Your use of the App is also governed by our Privacy Policy. All data entered into the App is stored locally on your device. We do not collect, transmit, or have access to your data. As a result:

• We cannot recover your data if you lose your device or uninstall the App without creating a backup
• You are solely responsible for backing up your data
• We are not liable for any data loss resulting from device failure, App uninstallation, or any other cause

6. Intellectual Property

The App, including its design, code, graphics, icons, and content, is the property of Flushy and is protected by applicable intellectual property laws. You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App's name, logo, or branding without prior written permission
• Create derivative works based on the App

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim related to the App shall not exceed the amount you paid for the App

8. Health Information Accuracy

While we strive to provide accurate health information based on recognized medical sources (including the Bristol Stool Scale, World Gastroenterology Organisation, and World Health Organization guidelines), we do not guarantee the accuracy, completeness, or timeliness of any health information presented in the App. Health guidelines may change, and individual health conditions vary.
